I am directed by the Board of Frade to refer to your letter of the 15th February (1814-11/12) enclosing
a copy of an Ordinance relating to Companies passed by
the Legislature of Hongkong, together with a copy of a
report thereon by the Attorney-General, and in reply I
am to inform you that the only observation which the
Board of Trade desire to offer is to point out that the
effect of section 253 of the Ordinance is, apparently,
to require British companies incorporated outside the Colony to obtain the special consent of the Governor in
Council to acquire land in the same way as such consent is required by a foreign company, notwithstanding the paragraph in the report of the Attorney-General in which
it is stated that section 253 has been recast with a view
to assimilating the law of the Colony to the law of the United Kingdom. Section 275 of the Imperial Consolida- tion Act provides that a company incorporated in a British possession which has filed with the Registrar certain documents corresponding with those required by section 253(1)(b) of the Hongkong Ordinance shall have the same power to hold lands in the United Kingdom as if it were a company incorporated under the Imperial Act.
